This is a proceeding, instituted by the plaintiff against the defendant, in the Circuit Court of Leon Count)', to procure a .decree of that Court to enable the plaintiff to cause the equity or legal right of redemption in certain property of the defendant to be sold by Virtue of an execution at law, pursuant to the provisions of an act of the General Assembly of 1845, Chap. 44, Sections 1 and 2, Thompson’s Digest, pages 355, 356, Nos. 3 and 4.
