This appeal is from a judgment entered after respondents’ motion to dismiss the complaint was granted in the second of two ac tions filed by appellant, Craig B. McKinney, against respondents. The litigation arises out of the termination of appellant’s employment as a probationary deputy sheriff by respondent County of Santa Clara on June 18, 1976.
