MEMORANDUM OF DECISION AND ORDER
SPATT, District Judge.
On October 13, 1998 Michael D. Rand (the “plaintiff’ or “Rand”) commenced this action in the Supreme Court of the State of New York, County of Nassau. On November 13,1998 The Equitable Life Assurance Society of the United States (the “defendant” or the “Equitable”) removed the action from the State Supreme Court to the United States District Court for the Eastern District of New York.
