This action was brought for the specific performance of a contract to convey real property, and by the pleadings the single question as to whether the plaintiff at the time the contract was to be completed had a marketable title to the premises Nos. 233 and 235 East Ninety-fifth street, in the city of New York, which by the contract the plaintiff had agreed to convey to the defendant, is pre*506sented.
