This was a proceeding by appellant, under the general act for the incorporation of cities and villages, to open Bhodes avenue, in the city of Chicago, under a petition filed for that purpose on the 31st of October, 1883, in the Superior Court of Cook county. The damages for the property to be taken having been ascertained, a supplemental petition was filed, under article'9, of chapter 24, of the Bevised Statutes, concerning cities, villages and towns, in the same court, to assess the benefits of such opening upon property benefited thereby, and to that extent raise money to be applied toward…
