RULING ON DEFENDANT’S MOTION TO DISMISS

DRONEY, District Judge.

The amended complaint (“the complaint”) in this action seeks damages under the Federal Tort Claims Act (the “FTCA”), 28 U.S.C. § 1346(b)(1). The plaintiff, Annette LaFrancis, brings this action against the defendant, United States of America, claiming negligence resulting in injuries she sustained when she was assaulted by her former husband, Chief Petty Officer Lance LaFraneis (“Chief LaFraneis”).
