Before the court is plaintiffs motion for summary judgment. After careful consideration of the arguments of counsel, the rele*422vant case law, and the record as a whole, the court issues the following order.

FACTS

On August 15,1990, defendant M.J. Taylor filled out an application for a three-year “nursing home” insurance policy with plaintiff Network America Life Insurance Company. Subsequently, E.
