This case is before us on remand from our Supreme Court. In a prior opinion, we upheld the Michigan Employment Relations Commission’s finding that respondent, Michigan Department of Mental Health (dmh) is a joint employer with respondent Louisiana Homes, Inc., a nonprofit residential home care provider, of the direct-care workers at three Louisiana Homes facilities.
