Appeal from an order of the Court of Claims (Collins, J.), entered October 3, 2000, which, inter alia, denied claimant’s motion for summary judgment.

In 1995, Lorenzo Brooks, a prison inmate, commenced an ac*768tion in the United States District Court for the Northern District of New York against Kirk Montgomery and other correction officers employed by the Department of Correctional Services.
