This is an action of assumpsit on an unusual contract of insurance, — known as “FINANCE FIRE AND THEFT CONTRACT — Open Policy — Certificate Plan” —covering loss and damage to an automobile truck by fire and theft. It is to be hoped that, if its use becomes general, it will be so construed as to furnish greater safeguards and protection to the owner of the truck than we¡re accorded the plaintiff in this case. The policy, as interpreted by the defendant, seems to have been applied almost wholly, for the benefit of the seller of the truck, or its affiliate finance…
