This case came before the Court on Motion to Dismiss or Convert filed by Nations-Bank of Florida, N.A. (“NationsBank”). 1 A hearing on the motion was held on August 4,1992. Upon the evidence presented, the Court makes the following Findings of Fact and Conclusions of Law:
