This appeal involved the question of the liability of a surety upon a bond taken in certain proceedings below. The Chancellor discharged the surety.

In 1920 J. H. Wright and C. W. Dorman entered into a trade whereby Wright was to convey to Dorman a farm in Franklin County, and in exchange for the farm Dorman was to convey to Wright certain property in Nashville, including a grocery store. Wright took possession of the grocery store but the parties got into a dispute about that time and the trade was not completed.
