On November 9, 1991, a jury convicted the defendant of murder in the first degree on the theory of felony-murder.1 The defendant has appealed from his convic*699tian and argues further that the judge erred in denying his motion for a new trial because, as he claims, the jury verdict was not unanimous. After explaining that the judge’s instructions on the theory of felony-murder were adequate and that he did not abuse his discretion in declining to poll the jury, we discuss the principal issue in this case, whether the judge erred in ruling that the jury’s verdict was unanimous.
