Before the Court are two motions brought by Defendants New York Presbyterian Hospital (“NYPH” or “the Hospital”) and the City of New York (the “City”), seeking summary judgment on Plaintiffs claims relating to his arrest by NYPH Special Patrolmen on May 14, 2007. Plaintiffs Complaint pursues multiple claims under 42 U.S.C. § 1983, as well as state claims for assault and battery, false arrest, malicious prosecution, negligence, and negligent hiring, training and retention.
