Appellee Howard Lee Griggs was indicted by a Harris County grand jury for the felony offense of possession of a controlled substance, namely cocaine. The appellee moved to suppress the evidence on the grounds that the officer’s affidavit in support of the application for the search warrant that lead to the appellee’s arrest and indictment lacked substantial evidence that any contraband or illegal drugs would be found inside the premises to be searched.
