This cause is before the court upon an appeal from the judgment of -the trial court and order denying a new trial herein. The action is one in claim- and delivery, and was tried before the trial court without a jury; such court made and entered findings of fact and conclusions of law herein in favor of defendant Hill, respondent in this court.
