RODRIGUEZ, District Judge.

On this day, the Court considered cross motions for summary judgment submitted on October 20, 2003. In addition, the Court considered responses, replies, and sur-replies submitted by both parties. While the parties did not agree as to the exact scope of inquiry presented to this Court by the Federal Circuit’s remand, both provided ample documentation and legal arguments for consideration.
