*1386Appeals from an order of the Supreme Court, Erie County (Diane Y. Devlin, J.), entered July 31, 2006 in a personal injury action. The order, inter alia, substituted Acea M. Mosey, as public administrator of the estate of Joseph M. Billick, deceased, for defendant Joseph M. Billick.
It is hereby ordered that the order so appealed from be and the same hereby is unanimously affirmed without costs.
