OPINION

CLAY, Circuit Judge.

Petitioner, Alton Coleman, appeals from the district court order denying Petitioner’s motion, pursuant to Rule 59(e) of the Federal Rules of Civil Procedure, to alter or amend the district court order denying Petitioner’s application for writ of habeas corpus pursuant to 28 U.S.C. § 2254 and lifting the stay of execution previously entered by the district court. For the reasons set forth below, we AFFIRM IN PART and REVERSE IN PART and REMAND for further proceedings…
