Lowther and another, from so much of an order of.the Supreme Court, made at the New York Special Term and entered in the office of the clerk of the county of New York on the 31st day of May, 1906, as resettled by an order entered in said clerk’s office on the 7th day of June, 1906, as denies the motion of the defendant Amelia E. Lowther to vacate a subpoena duces tecum theretofore served herein. .

Houghton, J.:
The plaintiff recovered in the Supreme Court a judgment against the defendant for a large sum of money, and upon return of execution unsatisfied instituted before one of the justices of that court, proceedings supplementary to execution. An examination of the judgment debtor had been had, but the proceeding itself had not been concluded, and was still pending before the justice who granted the original order.
