MEMORANDUM, DECISION AND ORDER

McAVOY, Chief Judge.

This action arises out of plaintiff Paul Amato’s arrest and booking at defendant Saratoga Springs Police Department (“the Department”) on May 26, 1994. Plaintiff alleges that while he was being booked, defendants Robert Flanagan and Lynn Thomas 1 used excessive force on him, and then denied him medical treatment.
