This action arises out of the detention of plaintiff, Ramon Mendez Houston, a citizen of the Republic of Mexico. Houston was allegedly committed to the sheriffs custody as a material witness pursuant to N.R.S. 178.494 to an offense of first degree murder and was held in custody by officials of Humboldt County, Nevada for over a year and until his release on a writ of habeas corpus issued by the United States District Court.
