Original alternative writ of mandamus issued out of this court.

On December 23, 1946, the petitioner, Henry M. Haslam, filed in this court his verified application for a writ of mandate. He alleged that there was then pending in the First District Court, in and for Cache County, before the respondent Marriner M. Morrison, District Judge, an action for false imprisonment in which petitioner was plaintiff and Charles B.
