SMITH, Chief Judge.

This dispute involves a request by defendant to file its affidavits out of time under RUSCC 6(b)(2). The purpose of these affidavits is to supplement defendant’s response to plaintiffs’ cross-motion for partial summary judgment presently pending before the court. Plaintiffs have responded by opposing defendant’s motion contending that these supplemental affidavits were filed in bad faith and if accepted would be of prejudice to plaintiffs’ position.
