In the above referenced case, Peter J. Pinaud (“plaintiff”), a resident of Florida, brings suit under 42 U.S.C. § 1983 against current and former Suffolk County Assistant District Attorneys David Freundlich (“Freundlich”), John Holownia (“Holow-nia”), Kevin Fitzgerald (“Fitzgerald”), Patrick J.
