The appellee, Alice Bullís, joined by her husband, John Bullis, sued the appellants for partition of section eight, block eight, in Presidio county, she claiming an undivided one-fourth interest in said section of land, and alleging that the remainder belonged to the Presidio Mining company. She alleged that on the eighth of June, 1882, William Shafter, "Louis Wilhelmi, John A.
