In this declaratory judgment action, the district court ruled the appellant, Nationwide Agri-Business Insurance Company, had coverage under an automobile liability insurance policy for claims made against its insured, Jim Goodwin, arising out of an accident that occurred when Goodwin loaned a vehicle he had rented to his uncle, Jack Jolin. Nationwide claims on appeal there is no coverage because Goodwin was not “using” the vehicle at the time of the accident so as to fall within the definition of “insured,” and in any event, coverage was excluded by a provision excluding…
