Westbrook, as trustee in bankruptcy of the consolidated Motor Car Company, an insolvent corporation, brought an equitable petition against Spratling and a number of others, to recover the alleged unpaid stock subscriptions of the corporation. So much of the petition as is necessary for consideration in disposing of the questions made in the record is, in substance, as follows: Each of the defendants is indebted to the corporation for unpaid stock subscription in the amount charged against him.
