St. Andrews Bay Community Hotel Corporation, a corporation, instituted an action to recover an unpaid balance of subscription contracts for stock in the said corporation against C. J. Bryan, the defendant. The declaration contains two counts and each count alleges that the defendant entered into a written contract and agreement with the plaintiff wherein and whereby the defendant subscribed for and agreed with the plaintiff to purchase of and from the plaintiff a certain number of shares of 8% preferred stock of the plaintiff of the par value of $100.00 per share, for which he agreed to pay…
