Appeal from a judgment of the Supreme Court (Ingraham, J.), entered May 7, 1998 in Otsego County, which, inter alia, granted defendants’ motion for summary judgment dismissing the complaint.
In 1993 defendants purchased a two-story, two-family dwelling in the Village of Cooperstown, Otsego County. The house, which they intended to use for their personal residence, consisted of two living units.
