Plaintiff Wilma Gnirk seeks compensatory damages against The Ford Motor Com pany (Ford) for emotional distress inflicted upon her while witnessing the death of her child, a passenger in a Ford car. 1 Ford moves for summary judgment, contending that plaintiff, as a “bystander” cannot recover for emotional distress because (1) it was not intentionally inflicted upon her by Ford; and (2) since she sustained no “accompanying physical injury, i.e., a physical impact and attendant, contemporaneous physical injury”, even if Ford’s legal liability…
