The Kellogg-Mackay Company, which was the plaintiff in the trial court, seeks a reversal of a judgment entered against it and in favor of the defendant Hartford Accident & Indemnity Company.
The action was originally begun against the defendant Eugene F. O’Neal, seeking to replevin 600 shares of Federal Radiator & Boiler Company stock, held hy him for the benefit of others interested therein. Since the inception of this suit, which was first filed January 2, 1929, O’Neal has died and the stock is now held by agreement hy the clerk of this court pending the outcome of this suit.
