LORD, Senior Judge.
Charles and Judith Shay and Don Herzog and Tri-State Development Corporation (Tri-State) appeal an Environmental Hearing Board (EHB) decision of June 16, 1993 which reads as follows:
AND NOW, this 16th day of June, 1993, it is ordered that the appeal is dismissed except with respect to Don Herzog’s liability under § 316 of the CSL. The appeal is sustained to that extent.
