Appellant was indicted, tried by a jury, and convicted upon charges of aiding and abetting one Gardner in the willful misapplication of funds of The Farmers and Merchants State Bank of Fredericksburg, Virginia, Incorporated, in violation of Section 592 of Title 12 of the United States Code Annotated. Gardner was indicted in twenty counts relating to twenty transactions. Appellant was charged as aiding and abetting in thirteen of those transactions.
