' In an action before a justice of the peace of Logan county, a judgment was obtained by J. E. McDonald against the Chesapeake and Ohio Railway Company, for $13.50 and the costs, after appearance of the defendant railway company, issue and trial. No objection to the jurisdiction of the justice .was advanced during the pendency and trial of the action, but after the rendition of the judgment the railway company proceeded in prohibition against it, in the circuit court of said county, on the ground that the justice was without jurisdiction as to the cause of action upon which…
