On the 6th day of June, 1887, Allen G. Burner filed his bill in chancery against Uriah Iieveuer, in which he set out that a certain creditor of his had brought a suit against him in the Circuit Court of Pocahontas county to subject his lands for the payment of his debts ; that in said suit (Arbo-gast v. Burner etc) a tract of one hundred fifty four acres, and an undivided one fourth interest in a large mountain tract, was advertised to be sold by R. S.
