MEMORANDUM OPINION

MCKELVIE, District Judge.

This is a social security case. Plaintiff Gwendolyn Portlock is a resident of Delaware whose claim for disability, benefits has been denied by the Commissioner of Social Security. Defendant Jo Anne B. Barnhart is the Commissioner of Social Security for the Social Security Administration (“SSA”).

Presently before the court is the Commissioner’s motion to alter or amend the court’s earlier order granting summary judgment to the Commissioner in part and remanding the ease in part to the administrative law judge for the sole purpose of deciding whether…
