— This was a suit by appellees against appellants, upon a bond given by them to the board of education of the city of South Bend, Indiana. The complaint filed by appellees (plaintiffs below) avers that appellant Hutton, on the 19th day of September, A. D. 1896, entered into a contract with the board of education of South Bend, to build for said board of education, a certain sclioolhouse, according to certain plans provided by the board of education, for which Hutton was to receive a certain price stipulated in said contract.
