In this action the administrator de bonis non of the estate of Sarah W. Story seeks to recover from the defendant Hall, bondsman for Joseph C. Enright as executor of the estate of Henry L. Story. The facts were found by the court. The sum which the plaintiff was entitled to recover, if he could recover at all, was agreed upon. On the facts found-the court rendered judgment for the plaintiff for the agreed amount. The defendant excepted.
