' This is a declaratory judgment action arising out of the construction of a new residence. Before the Court are pending cross-motions for summary judgment filed by Plaintiff and Counterclaim Defendant Pennsylvania National Mutual Casualty Insurance Company (“Penn National”), and Defendants and Counterclaim/Cross-claim Plaintiffs Howard and Pam Snider (collectively, the “Sniders”).
