BAKER, Judge.

The appellant was convicted of manslaughter in the District Court of Liberty County, and his punishment assessed at five years in the penitentiary.

The record discloses that the homicide took place at a dance on the night of December 25, 1923. It was the contention of the state, and evidence was introduced to that effect, that the appellant, while under the influence of whiskey and without cause or provocation, shot the deceased with a pistol, from the effects of which he died about nine days later.
