We granted the defendant’s application for further appellate review, see Brown v. Quinn, 27 Mass. App. Ct. 288 (1989), to examine the propriety of the dismissal of a draft report pursuant to Dist. Mun. Cts. R. Civ. P. 64 (c) (5) (1989). The rule provides for dismissal of a draft report if no action has been taken on it within three months of its filing. 3 We agree with the Appeals Court that there was no error in the order of the Appellate Division dismissing the report.
