This case is a declaratory judgment action, filed by the plaintiff City of Kansas City, Kansas (the “City”), requesting a determination by the court that a special use permit issued to defendant AIH Waste ManagemenVIncineration, Inc. (“AIH”) has expired pursuant to a city ordinance. The matter is currently before the court on AIH’s motion for summary judgment (Doc. # 24).
