While defendant was the receiver of the plaintiff company, all the shares of stock of the company remaining unissued (680 shares of $100 each) were issued to him, and 70 'shares already issued were transferred to him, in consideration of his undertaking to make advances of money to the company for enabling it to operate its plantation; and this suit is by the other stockholders of the company and by the company itself to have this issuance and transfer of stock set aside pn the ground that the relation of trust in which defendant stood towards the company and its stock*357holders precluded him…
