Appeal by the defendant, Ludwig & Company, from a judgment of' the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Orange on the 14th day of May, 1910, upon the verdict of a jury for $1,429.19, and also from an order entered in said clerk’s office on the 25th day of May, 1910, denying the defendant’s motion for a new trial made upon the minutes.

Some two weeks prior to July 22, 1903, the defendant in the use and occupation of premises known as No. 48 Water street, in the city of Newburgh, caused an independent contractor to place a sign over the door on the outside of the front wall of the building and immediately adjacent to or overhanging the public street at that point.; This sign is described as a thick board, some eight or nine feet long and two or three feet wide, with a sort of railing or frame, two and a half or three inches thick around the edges.
