Mahan v. New Hampshire Department of Administrative Services
Supreme Court of New Hampshire
1Opinion of the CourtBrock, C.J.
The plaintiffs, Joseph and Irene Mahan, sued the defendant, New Hampshire Department of Administrative Services (State), for negligence after Joseph Mahan (hereinafter the plaintiff) was seriously injured while working in a State-owned building. After the Superior Court (McGuire, J.) denied the State’s motion for summary judgment, a jury returned a verdict in favor of the *748plaintiff. The State argues that sovereign immunity bars the plaintiff’s claims, and that the court erred in allowing reference at trial to RSA 277:2 (1987) and related labor regulations. We affirm.
