HUDSON, Judge.

Jeffrey Allen Bray (“plaintiff’) appeals from a decision and order of the North Carolina Industrial Commission (“the Commission”) denying his claim for damages. We affirm.

The facts, on the basis of stipulated evidence, are as follows. Plaintiff was injured on 23 February 1995 when the vehicle he was driving was hit by a patrol car driven by State Highway Patrolman Kevin Patrick Woods.
