The Keen Woolf Oil Company, appellant, brought this suit against Robert Fulenwider, appellee, to recover the sum of $849.79, with interest and protest fees; being the amount of Fulenwider's unpaid "trade acceptance" covering the purchase price of a carload of oils sold to him by the oil company. The validity or amount of this obligation was not questioned by appellee, and judgment thereon was rendered against him in appellant's favor. But appellee urged a cross-action against appellant for $773.68, or $337.64 in the alternative, as damages for breach of a contract alleged to have been made by…
