Pending before the Court is Defendant City of Houston’s (“City”) Motion to Dismiss [Doc. # 45]. Plaintiffs have responded [Doc. # 47]. Because Plaintiffs requested that the Court consider matters outside of the pleadings in deciding the City’s motion, the Court converted the motion to dismiss to a motion for summary judgment and invited the City to submit evidence in support of its position. 1 The City has replied [Doc. # 51]. 2 Upon review of the parties’ submissions, all pertinent matters of record, and applicable law, the Court concludes…
