This suit was instituted to recover damages on account of the death of J. T. Mangrum, Jr., a child about three and one-half years of age, claimed to have been killed by one of the Railway’s trains on November 28, 1931, while playing on an overhead bridge just east of Camden, Tennessee.

At the conclusion of all of the evidence in the case the Railway moved for a directed verdict in its favor on each count of the declaration. The motion was overruled and the Railway seasonably excepted.

The jury returned a verdict against the railway in the sum of $10,000.
